Adli kontrol

Abstract

5271 sayılı CMK ile ceza muhakemesi hukukumuza kazandırılan adli kontrol, tutuklamaya alternatif bir kurumdur. Adli kontrol, CMK'nın dördüncü kısmının Koruma Tedbirleri başlığı altında üçüncü bölümünde 109 ila 115. maddeleri arasında düzenlenmiştir. Adli kontrol koruma tedbirinin uygulanması ile ulaşılmak istenen sonuç, diğer koruma tedbirlerinde olduğu gibi ceza muhakemesinin yapılabilmesini ve hükmün icrasını sağlamaktır. Adli kontrol tedbirine tutuklamanın amacından başka bir amaçla başvurulamaz. Çünkü bu tedbire tutuklamanın amacını gerçekleştirebilecek daha hafif bir tedbir olduğundan onun yerine başvurulur.Çalışmamızda AİHM kararları ışığında tutuklama tedbirinin haksız uygulanmasından kaynaklanan davalarda AİHM tarafından verilen ihlal kararları incelenmiştir.The judicial control, which has been brought in our criminal procedure law with Code of Criminal Procedure no 5271, is an alternative mean to arrest. The judicial control is regulated between the article 109 and 115 in the third section under the title of Protection Measures of fourth part of Code of Criminal Procedure. The intended outcome with application of the protection measure of judicial control is to conduct criminal procedure just as in the other protection measure and enforce the decision. No other objective is intended other than the objective of arrest for the judicial control measure. For this measure is a lighter measure to realize the objective of arrest, it is applied rather than the arrest.Our study examines the violation rules given by the ECHR in the cases arising out of the unjust application of arrest measure in the light of the ECHR rulings.
