Cumhuriyet savcısının kamu davası açmada takdir yetkisi

Abstract

5271 sayılı Ceza Muhakemesi Kanunu md. 171/1'de şahsi cezasızlık sebebi veya cezayı ortadan kaldıran etkin pişmanlık hükümlerinin uygulanmasını gerektiren durumlarda Cumhuriyet savcısına kamu davasının açmada takdir yetkisi, maddenin ikinci fıkrasında ise kamu davasının açılmasının ertelenmesi kurumuna yer verilmiştir.In cases that require the enforcement of personel reason for impunity or effectiv regret that allows exemption from punishment provisions in the Article numbered 171/1 of the Criminal Procedure Law numbered 5271, the Public Prosecutor is given the discretionary power to initiate a public prosecution, and the second paragraph of the article included the postponement of initiation of public prosecution.
