In a verdict of the Supreme Court Assembly of Civil Chambers (dated 22.3.2017, 2017/4-1334 B. and 2017/545 V.), it was finalised that third person who had sexual intercourse with a married person requires to pay compensation to the spouse who is damaged due to the violation of the duty of loyalty on several grounds. In this paper where there is such a framework, the legal grounds in related verdicts of the Supreme Court will be examined to be able to clarify the legal obligations of the spouse violating the duty of loyalty and third person in case of the violation of the duty of loyalty.Article Yargıtay Hukuk Genel Kurulu'nun 22.3.2017 Tarih, 2017/4-1334 Esas ve 2017/545Karar Sayılı Kararı Üzerine Eleştirel Bir Yaklaşım(2017) Öztan, Bilge; Tolunay Ozanemre Yayla, Hatice; 21756Eşlerden birinin evlilik birliğinin getirdiği yükümlülüklerden biri olan "sadakat yükümlülüğü"nü ihlâl etmesi hâlinde, diğer eşin, eşiyle birliktelik kurmuş olan üçüncü kişiye karşı tazminat dâvası açma hakkına sahip olup olmadığı ve bu çerçevede, gerek yükümlülüğünü ihlâl eden eşin gerek üçüncü kişinin, sadakat yükümlülüğünün ihlâli nedeniyle zarar gören eşe karşı sorumlulukları özellikle Yargıtay Kararları çerçevesinde yeknesak olmaktan uzaktır. Yargıtay, vermiş olduğu bir Hukuk Genel Kurulu Kararı'nda (22.3.2017 t., 2017/4-1334 E. ve 2017/545 K.), sadakat yükümlülüğünün ihlâlinde, evli kişiyle cinsel birliktelik yaşayan üçüncü kişinin, yükümlülüğün ihlâlinden zarar gören eşe tazminat ödemesi gerektiğine çeşitli gerekçelerle karar vermiştir. Bu çerçevede çalışmada, ilgili Yargıtay Kararında yer alan hukuki dayanakların irdelenmesiyle, sadakat yükümlülüğünün ihlâlinde, yükümlülüğü ihlâl eden eş ile üçüncü kişinin hukuki açıdan sorumluluk durumları aydınlatılmaya çalışılacaktır.
