Article A View on the Future of Judicial Review of Cons’t Amendments in Turkey(2019) Acar, Ali; 140373; HukukIn this article, I discuss and analyse the Turkish case concerning judicial review of constitutional amendments in light of a recent decision by the Constitutional Court of Turkey (CCT). In the said decision, the CCT rejected carrying out judicial review over a controversial constitutional amendment, which lifted MPs’ parliamentary immunity. This decision urges to consider its implications for the possible future cases. I refer to comparative constitutional law with the hope to shed more light on the Turkish example and grasp it comprehensively. In this respect, I illustrate the most crucial arguments developed by the Supreme Court of India (SCI), the Bundesverfassungsgericht (BVG), and the Conseil Constitutionnel (FCC) in their case law. Based on the comparative account, I draw some lessons for the CCT and invite it to get into a judicial dialogue with other supreme/constitutional courts with regard to the issue.Article Agency Agreements In American Law;Comparısıon With Turkish Civil Law(2003) Efem, Gül; 233446; HukukAgency is a relationship between two persons whereby one of them (the agent) is authorized to act for and on behalf of the other (the principal). All rights reserved.Article The Changes and Innovations of the New International Labour Force Law about the Working of Foreigners in Turkey(2017) Gümüşlü Tunçağıl, Gülce; 45484International Labour Force Law entries into force on 13 August 2016 and changed the previous act named the Law on Work Permits of Foreigners. This law’s aims are to determine and implement the policies on international labour; regulate the principles and procedures on work permit and work permit exemptions given to the foreigners. Foreigners can only work in some professions which are not prohibited. The main rule is that foreigners who want to work at Turkey shall obtain a work permit from the Ministry of Labour and Social Security. But this main rule has an exception that the relevant foreigners can take the work permit exemptions to work. Some applications can be submitted through the authorised agent (this is the new provision brought by the new law). Besides, foreigners working at some services that require vocational qualifications shall obtain the pre-authorisation. For instance, if a foreigner wants to work as an instructor at university, it should be necessary to take this from the Council of Higher Education or if a foreigner wants to work as a teacher at private high school, Ministry of National Education gives this authorisation. This is one of the changes brought with the new law. The other changes are about the types of work permit. The conditions, entitled persons, the terms of durations of the four types of work permit are changed. This Law contains the specific provisions about working of the foreign students and the foreigners being within the scope of international protection. And also this law has specific provisions for the foreigners working in the free zones. The last change that should be mentioned is the implementation of Turquoise Card; the foreigners given this card have also same rights as Turkish citizens. Bu kriterlerden biri de ‘azınlıklara saygı ve onların korunması’dır. Bu makale, AB’ye üyelik şartı olan azınlık hakları korunmasın sınırlarını ortaya koymaya çalışmaktadır. Buna ilaveten, bu şartın Türkiye’ye uygulanmasına ilişkin bazı gözlemlere yer vermektedir. Bu bakımdan, öncelikle, azınlıkların korunması şartının hangi tarihsel ve siyasi koşullar altında formüle edildiği açıklanmıştır. Devamında ise, AB mevzuatında azınlıkların korunmasıyla, çoğunlukla dolaylı olarak, ilgili olan kurallar özetlenmiştir. Bunu özeti takiben, azınlık hakları koşulunun sınırlarına ilişkin daha genel bir açıklama yapılmıştır.
