Abstract
7036 sayılı yeni İş Mahkemeleri Kanunu ile Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu’nun 13’üncü maddesine eklenen
üçüncü fıkra hükmüne göre, arabuluculuk sürecinde ortaya çıkan
arabuluculuk ücretini karşılamak için adli yardıma ihtiyaç duyan taraf, Hukuk Muhakemeleri Kanunu’nun bu husustaki hükümlerinin
kıyas yoluyla uygulanması suretiyle adli yardımdan yararlanabilir. Ancak anılan fıkrada bu hususta görevli mahkeme sulh hukuk mahkemesi olarak belirlenmiştir. Bu düzenleme, hem Hukuk Muhakemeleri
Kanunu’nun adli yardımda görevli mahkemeye ilişkin hükümleri ile
hem de Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu’nun göreve
ilişkin diğer hükümleri ile çelişmektedir. Çalışmada öncelikle, adli yardımda görevli mahkemeye ilişkin Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu’nu hükmü; ardından Hukuk Muhakemeleri Kanunu
hükümleri incelenecektir. Hükümler arasındaki çelişkinin yol açabileceği sorunlar tespit edilerek, bu sorunların giderilmesi için çeşitli
çözüm önerilerinde bulunulacaktır.
According to Article 13 of Code of Mediation in Civil Disputes which is changed by the new Labour Courts Law No. 7036, the party in need of legal assistance to meet the mediation fee arising during the mediation process can benefit from legal assistance by applying the provisions of Turkish Civil Procedure Code by comparison. However, in Article 13 the court which has jurisdiction for this matter has been determined as the Civil Court of Peace. This regulation contradicts both the provisions of Turkish Civil Procedure Code about the court which has jurisdiction for legal aid and the other Jurisdiction of courts provisions of Code of Mediation in Civil Disputes. In the study, first, the provisions of Code of Mediation in Civil Disputes relating to the court in charge of legal aid and then those of the Turkish Civil Procedure Code shall be examined. The problems that may result from the contradiction between the two provisions will be identified and suggestions will be made to resolve these problems.
