Türk Anayasa Mahkemesi ve Yargısal Aktivizim

Abstract

Bu çalışmada Türk Anayasa Mahkemesi' nin hukuk devletinin sınırlarını zorlayarak takındığı aktivist tutum ve yasama organının bu aktivist tutuma karşı tepkisi incelenmiştir. Üç bölümden oluşan çalışmanın ilk bölümünde anayasa yargısının dünyadaki ve ülkemizdeki gelişimi hakkında bilgi verilerek, anayasa yargısının meşruluğu konusundaki pozitif ve negatif düşünceler ortaya koyulmuştur. Çalışmanın ikinci bölümde Türk Anayasa Mahkemesinin aktivist tutumu konu edilmiştir. Bu bölümde Mahkemenin aktivist tutumu somut olaylar çerçevesinde irdelenmiş ve somut örneklerle aktivist tutumun varlığı ispatlanmıştır. Üçüncü bölümde ise aktivist tutumun yansımaları inceleme konusu yapılmıştır. Yasama organının Mahkemenin müdahaleci yaklaşımına karşı tepkisi, etki-tepki dalgası içerisinde ortaya konulmuştur. Türk Anayasa Mahkemesinin aktivist tutumunun sürekli hale gelmesi, yasama erkinin bu tutuma karşı bir tepki refleksi geliştirmesine neden olmuştur. Özellikle son günlerde tanık olduğumuz Türk Anayasa Mahkemesinin yapısını değiştirmeye yönelik girişimler ise bu durumun açık örneğini teşkil etmektedir.

This study examines the activist attitude Turkish Constitutional Court assumes, pushing back to limitations of the rule of law, and the reaction of the legislative organ to this activist attitude. The study consist of three section;the first section informs about the development of the constitutional justice both at home and in the world and it presents the arguments (both pro and con) about the legality of the constitutional justice. The second section focuses upon the activist attitude of the constitutional court analyzing this attitude in the light of concrete event and eventually proves with tangible example the existence of such an activist attitude. The third section centers around the reflections of this activist attitude and displays in a context of action&reaction, the response of the legislative body to the interruptive attitude of the court. The activist attitude of the Constitutional Court in time become habitual, which developed in the legislative organ a reflex for reaction. Attempts to change the structure of the Constitutional Court stand as the clear manifestation of this state of affairs.
