İki Hukuk Devleti, İki Devlet Teorisi Mübadele Mantığı, Sermaye Mantığı

Abstract

Birbirinin yerine kullanılagelen ve benzer anlamlara sahip olduğu düşünülen İngilizce “Rule of Law” karşılığı “hukukun üstünlüğü” ve Almanca “Rechtsstaat” karşılığı “hukuk devleti” kavramlarındaki hukuk ve devlet üzerine vurguların iki farklı kapitalist gelişme tarzının ürünü olduğunu ileri sürüyorum. Marksist teori içerisinde yer alan mübadele mantığı ve sermaye mantığı yaklaşımları, kapitalist gelişme tarzının ürünü olan kavramlar arasındaki farklılıkları gün yüzüne çıkarmada elverişli araçlar sunuyor. Kavramlar arasındaki ayrımı bu iki yaklaşım biçimleriyle açıklamak genel hukuk teorisi yanında hukuk sosyolojisinin kimi konularına ilişkin de sonuçlar üretmektedir.I suggest that the emphasis on law and state in the English “Rule of Law” and the German “Rechtsstaat”, which are considered as interchangeable terms having analogous meanings, have emerged on account of two different capitalist modes of development. The logic of exchange and the logic of capitalism within the Marxist theory provide the tools for exposing the differences between concepts that are the products of the capitalist style of development. Explaining the distinction between concepts through the two approaches produces results in relation to some issues of sociology of law as well as general law theory.
