Abstract
Bilindiği üzere 22 Temmuz 2020 tarihinde HMK'da gerçekleştirilen önemli değişikliklerden bir tanesi de 149. Maddede yapılan değişikliktir. Esasen günümüzde yapay zeka sistemlerinde gerçekleştirilen devrimsel gelişmeler ile sanal gerçeklik alanına insanların üç boyutlu olarak girebilmeleri duruşmaların geleceğini kökten değiştirecektir. Hukuk normları her zaman olgular üzerine oluşturulmuşlardır. Olguların önümüzde ki on yıl içerisinde tüm alanlarda olduğu gibi hukuk normlarında da yenilenme ihtiyacı doğuracağı muhakkaktır. Her ne kadar e-duruşma ülkemizde ve dünyada dahi yeni sayılsa da geleceğin en büyük pratik uygulamaları arasında yer alacağı kuşkusuzdur. E-duruşma sadece tahkikat aşamasıyla sınırlı kalmayacak olup gerek kanun yollarına ve belki artık ülke sınırlarının bilgi bakımından önemsiz hale geldiği günümüz koşullarında uluslararası yargı alanına taşınacağı kanaatindeyiz.
As is known, one of the significant changes implemented in the HMK (Code of Civil Procedure) on July 22, 2020, is the amendment made to Article 149. Essentially, revolutionary developments in artificial intelligence systems and the ability for individuals to enter the virtual reality space in three dimensions will fundamentally transform the future of trials. Legal norms have always been established based on facts. It is certain that the need for renewal, as seen in all areas in the coming decade, will also affect legal norms. Although e-trials may be considered new in our country and globally, it is undoubtedly among the most significant practical applications of the future. E-trials will not be limited to the investigation stage alone and, given the conditions of today where national borders may become insignificant in terms of information, it is likely to move into the realm of international jurisdiction.
