Yargı bağımsızlığı ve hakimlik teminatları çerçevesinde hakimler ve savcılar yüksek kurulunun kuruluşu ve çalışma esasları

Abstract

Bu çalışma yargı bağımsızlığı ve hakimlik teminatları çerçevesinde Hakimler ve Savcılar Yüksek Kurulunun kuruluşu ile işleyişinin incelendiği bir çalışmadır. Amacımız, yargı faaliyetlerinin en iyi şekilde gerçekleştirebilmek için yargı bağımsızlığının tam sağlanması ve müdahalenin önlenmesi konusunda alınması gereken önlemleri ortaya koymak ve 2010 yılında Anayasada özellikle Hakimler ve Savcılar Kurulu’nun kuruluşu ve işleyişindeki değişiklik çerçevesinde bu amacın ne şekilde gerçekleştiğini incelemektir. Yaptığımız bu çalışmada kullandığımız yönteme gelince, birinci bölümde önce yargı bağımsızlığı ve hakimlik teminatları karşılaştırmalı olarak incelendikten ve ikinci bölümde hakimlerin atama ve özlük işlemlerine ilişkin benimsenen sistemlerle ilgili olarak genel bilgi verildikten sonra yargı kurulları üzerinde durulmuştur. Üçüncü bölümde 1982 anayasasına göre hakimler ve savcılar yüksek kurulunun kuruluşu ve çalışma esasları incelenmiştir.This is a study which examines the establishment and functioning of High Council of Judges and Prosecutors in terms of judicial independence and the legal guaranty of judges. Our goal is to exhibit the required measures for achieving full judicial independence and preventing intervention in the judiciaryin order to carry out the judicial activities at the highest level as well as to examine in what way this goal is achieved within the framework of the 201O Constitutional amendment on the establishment of High Council of Judges and Prosecutors and its functioning in particular. With respect to the method we use in this study, in the first section the judicial independence and the legal guaranty of judges arecomparatively discussed, then, in the second section general information is given on the adopted systems on the appointment and personnel affairs of judges, and the judicial councils are handled as well. In the third section, in accordance with the 1982 Constitution Act, the establishment and rules of procedures of High Council of Judges and Prosecutors are examined.
