    Tenders have come into existence in order to meet the needs of the public in the most accurate way and are regulated by the state with the Public Procurement Law No. 4734 and the State Procurement Law No. 2886. Due to the size of the resources and the fact that the tenders made concern the state and society, it is also protected in terms of criminal law. The crime of bid rigging is regulated in Article 235 of the ninth chapter of the Turkish Penal Code No. 5237 titled Crimes Against Economy, Industry and Trade. The content of our study is based on the Turkish Penal Code No. 5237, and taking into account the decisions of the Supreme Court, the basic tender process, the formation of the crime, the penalties prescribed by the law and the disruptions that may arise during the process are examined. The qualified forms of the crime and the changes made within the scope of the qualified cases were examined.
