Abstract

Bu çalışma 6356 sayılı kanun kapsamında işçi sendikalarının yetkisini inceleyen bir çalışmadır. Yetkinin daha iyi izah edilebilmesi için konuyla sınırlı olacak şekilde toplu iş sözleşmesi ile ilgili temel kavramlara yer verilmiştir. Kapsamlı bir literatür taraması yapılarak ve Yargıtay kararlarına da yer verilerek yetki sürecinin yasal boyutu, önemi, sürece ilişkin eksiklikler ve yetki sürecinin etkisiz hale getirilmesi ele alınmış, eksikliklerin doktrin ve Yargıtay tarafından yorumlanması ve giderilmesi incelenmiştir.This study examines the authorization of labor unions within the scope of Law No. 6356. In order to better explain the authorization, the basic concepts related to collective bargaining agreements are included in a limited manner. By conducting a comprehensive literature review and including the decisions of the Court of Cassation, the legal dimension of the authorization process, its importance, the deficiencies related to the process and the ineffectiveness of the authorization process are discussed, and the interpretation and elimination of the deficiencies by the doctrine and the Court of Cassation are examined.
