Abstract

Eşya taşımalarında kullanılan taşıma belgeleri, taşımaya ve yüke ilişkin önemli bilgileri içerdiğinden taşımanın sorunsuz ve güvenli bir şekilde gerçekleşip gerçekleşmediği söz konusu belgelerden anlaşılır. Bu sebeple, belgelerin tam ve doğru bir şekilde hazırlanması ile doğru kullanılması son derece önemlidir. Aksi takdirde taşıma ilişkisinin taraflarının sorumluluğu gündeme gelebilir. Birinci bölümde, Taşıma Hukukunun genel esasları; taşıma kavramı, taşıma türleri, eşya taşıma sözleşmesinin unsurları, tarafları ve hukuki niteliği irdelenmiştir. İkinci bölümde, taşıma belgelerinin milletlerarası Konvansiyonlarda ve Türk Hukukunda düzenlenme biçimleri karşılaştırmalı olarak açıklanmıştır. Bu açıklama yapılırken taşıma türleri dikkate alınmış ve kara, demir, deniz ve hava yolu taşımalarına ilişkin taşıma belgeleri farklı başlıklar altında incelenmiştir. Üçüncü bölümde, taşıma belgelerinden doğan sorumluluk ve sorumluluktan kurtuluş halleri, ikinci bölümdeki sistematik takip edilerek incelenmiştir. Therefore, documents must be fully and accurately prepared and used. Otherwise, the responsibility of the parties in the transportation relationship may be raised. In the first section, the general principles of Transport Law are covered by the concept of transportation, the types of transport, the elements of the goods transport contract, the parties, and the legal nature. In the second section, the transport documents are described in the International Conventions and Turkish Law in comparative terms. During this explanation, the transport types were taken into account, and transportation documents for land, iron, sea and airway transport were examined under different headings. In the third section, the liability and liability disclaimers arising from the transport documents were systematically followed and reviewed in the second section.
