Yürütmenin yasamayı fesih yetkisi

Abstract

Türkiye'de Cumhurbaşkanlığı Hükümet Sistemi'ne geçilmesi ile yasama ve yürütme ilişkileri yeniden düzenlenmiştir. Bu kapsamda başkanlık sistemi temelinde yasamanın yürütmeyi fesih yetkisi tartışmaları ortaya çıkmıştır. Yeni düzenleme ile 1982 Anayasası'nda bulunan yürütmenin yasamayı fesih yetkisi, başkanlık sistemine dayanan Cumhurbaşkanlığı Hükümet Sistemi'nde yer almamıştır. Bununla birlikte hem yürütme hem de yasamaya seçimleri yenileme düzenlemesine gidilmiştir. Yürütmenin yasamayı fesih yetkisi bağlamında yaptığımız bu çalışma göstermiştir ki, yürütme siyasal iktidarın yasama faaliyetlerinde doğacak siyasal kriz ve kaos karşısında seçimlerin yenilenmesi ile bu durumu bertaraf etmek amaçlanmıştır.

After the Presidency Government System accepted in Turkey, legislative and executive government relations with the transition to the presidential system in Turkey has been reorganized. In this context, debates on the Dissolution of the parliament based on the presidential system have emerged. Presidential Government System based on the presidential System did not include the Dissolution of the legislation power which in 1982 Constitution. However, both the executive and legislative arrangements were renewed. This study, which we conducted in the context of the authority of the executive to dissolve the legislature, has shown that it is aimed to eliminate this situation by renewing the elections in the face of the political crisis and chaos that will arise in the legislative activities of the political power.
