Resmî belgede sahtecilik suçu

Abstract

Belgede Sahtecilik suçlarında; toplumun, doğru olduğu ve gerçeği yansıttığı yolunda güven sahibi olduğu ve belge olarak adlandırılan nesneler üzerinde, kamunun aldanmasını sağlayacak şekilde gerçekleştirilen fiiller cezalandırılmaktadır. Resmî belgede sahtecilik suçu, TCK' nın 204' üncü maddesinde düzenlenmiştir. Söz konusu hükmün ilk fıkrasında, özel kişiler tarafından işlenen resmî belgede sahtecilik suçu;ikinci fıkrasında ise kamu görevlisi tarafından işlenen resmî belgede sahtecilik suçu düzenlenmiştir. Üçüncü fıkrada ise cezanın ağırlaştırılmasını gerektiren bir nitelikli unsura yer verilmiştir. Yine, Kanunun 210, 211 ve 212' nci maddeleri de inceleme konusu suçla ilişkili hükümler içermektedir.

Forgery refers to show the fact differently than what it is or to replace the fact intentionally in terms of criminal law. As a "lie" in esence, forgery action' s defining aspects are corpus delicti and victim. The offence of forgery of official documents regulated under Art. 204 of the Turkish Criminal Code. The first paragraph of the Art. 204 regulates forgery offences committed by people who are not public officials, when the second paragraph of the Art. 204/2 regulates forgery offences committed by public officials. In the third paragraph of the Art.204 a qualified component is reguated whish requires aggravation of punishment. As such Art. 210, 211 and 212 of the Turkish Criminal Code comprise provisions regard with the offence of forgery.
