Avukatın malpraktis sorumluluğu

Abstract

Bu çalışmada, yargının bir parçası olarak, müvekkiline hukuki yardımda bulunmak ve onu temsilen hukuki işlem yapma yetkisine sahip olan avukatın, mesleki ve hukuk kurallarına uymayarak müvekkiline maddi veya manevi zarar getirmesi ve bunun sonuçları üzerinde durulmuştur. Çalışmanın ilk bölümünde, avukatlık mesleğinin özellikleri, vekalet sözleşmesi, avukatlık sözleşmesi ile vekalet sözleşmesi arasındaki farklar ve avukatın sorumlulukları anlatılacaktır. Çalışmanın ikinci kısmında ise, malpraktis kavramı, avukatın özen yükümlülüğü ve avukatın malpraktisine bağlanan sonuçlar ve Avukatlık Mesleki Sorumluluk Sigortası incelenecektir.This study examines legal malpractice and the results of material and moral damage brought by a lawyer, who is to provide legal assistance to the client and represent the client in accordance with the rules of professional conduct and the law. In the first part of this study, the characteristics of the legal profession, proxy agreement, the difference between the proxy agreement and the power of attorney agreement and the responsibilities of attorney shall be examined. In the second part of this study, the concepts of malpractice and negligence, the liability of the attorney and the results of breach of duty, also the Legal Malpractice Insurance shall be analysed.
