Taşıyıcının yük ve gecikme zararlarından doğan sorumluluğunu ortadan kaldıran özel haller

Abstract

Bu çalışmada, karayoluyla yapılan eşya taşımalarında taşıyıcının, yük ve gecikme zararlarından doğan sorumluluğu ve onun bu sorumluluğunu ortadan kaldıran özel haller incelenmektedir. Birinci bölümde; taşıma sözleşmesi kavramı, taşıma sözleşmesinin unsurları, taşıma sözleşmesinde sorumluluk süjeleri ve eşya taşıma işlerinde yük ve gecikme zararından doğan sorumluluk şartları ile bu sorumluluğun kapsam ve sınırları üzerinde durulmuştur. İkinci bölümde; taşıma sırasında meydana gelen olay ile ortaya çıkan zarar arasındaki illiyet bağını zayıflatan veya sarsan özel hallerin sorumluluğu ortadan kaldıran etkisi açıklanmıştır. Bununla birlikte, bu bölümde, Kanunda, alelade eşya ve taşınma eşyası taşımaları için ayrı ayrı öngörülen özel haller ayrı alt başlıklar halinde incelenmiştir. Üçüncü bölümde ise; sorumluluktan kurtulma imkânı tanıyan özel hallere dayanma hakkının kimler tarafından kullanılabileceği, hakkın kullanılması bakımından ispat yükünün mahiyeti ile bu haktan yararlanılması imkânının kaybedilmesine sebep olan haller detaylı şekilde anlatılmıştır.

In this study, the liability of the carrier arising from the load and delay damages in the transportation of goods by road and the special risks that relieve this liability are examined. In the first chapter, the concept of the contract of carriage, its elements, the liability subjects in the contract of carriage and the terms of liability arising from the load and delay damages in the transportation of goods, and the scope and limits of this liability are discussed. In the second chapter, the effect of special risks that weaken or undermine the casual relation between the event and the resulting damage during transportation is explained. However, in this chapter, the special risks which are specified seperately in the law for the transportation of ordinary goods and household items are examined in particular sub-headings. In the third chapter, who can use the right of benefiting from special risks that provide an opportunity to freed from liability, the nature of the burden of proof on the purpose of getting rid of liability by using this right and the several cases that lead to the loss of using the right to take advantage of special risks are described in depth.
