Anayasa Mahkemesi ve hukuk devleti

Abstract

The second article of The 1982 Turkish Constitution 1982. clearly indicates that Republic of Turkey is based on the rule of law. It sees that in Turkey wherein some restrictions have been imposed on the rule of law concept since the announcement of Constitution 1982, some deviations have occurred from time to time and the rule of law. This study prepared by me, consists of four sections. In the first section, I mentioned about the rule of law .11nd its required principles. In the second section, I dealt with the Constitution and the Constitutional Court. As to third section, I studied the rule of law from the perspective of the Constitutional Court and the principles of rule of law within the framework of decisions given by the Constitutional Court.

1982 Anayasası'nın 2. maddesinde Türkiye Cumhuriyeti'nin bir hukuk devleti olduğu açıkça belirtilmiştir. Türkiye'de dönem dönem hukuk devletinden sapmalar olduğu ve hukuk devleti anlayışının farklılaştığı görülmektedir. Hazırladığım çalışma dört bölümden oluşmaktadır. İlk bölümde Hukuk Devleti ve Hukuk Devletinin Gerekleri anlatılmaktadır. ikinci bölümde Anayasa Yargısı ve Türk Anayasa Mahkemesi'ne değinilmiştir. Üçüncü bölümde ise Anayasa Mahkemesine Göre Hukuk Devleti ve Anayasa Mahkemesi Kararlan çerçevesinde Hukuk Devletinin ilkeleri açıklanmıştır. çalışmanın son bölümünde ise Anayasa Uygunluk Denetiminin Sonucu ve Anayasa Mahkemesi Kararlarının Niteliği incelenmiştir.
