Eser sözleşmesinde işin kabulü ve yüklenicinin sorumlulukları

Abstract

Bu çalışmada Eser Sözleşmesinde işin Kabulü ve Yüklenicinin Sorumlulukları konusu ele alınmıştır. Konu beş ana bölüm başlığı altında incelenmiştir. Birinci bölümde Eser Sözleşmesinin tanımına, hukuki niteliğine, unsurlarına ve diğer benzer sözleşmelerden farklarına değinilmiştir. ikinci bölümde yüklenicinin sözleşmeden doğan borçları, üçüncü bölümde yüklenicinin ayıptan doğan borçları ele alınmıştır. Dördüncü bölüm yüklenicinin ayıptan sorumluluk borcunun sona ermesi ana başlığı altında incelenmiş olup son bölüm olan beşinci bölümde ise, 01 Temmuz 2012 tarihinde yürürlüğe girecek olan 6098 Sayılı Yeni Türk Borçlar Kanunu’na göre Eser Sözleşmesi uyuşmazlıklarına uygulanacak zaman aşımı sürelerine yer verilmiştir.This study deals with the subject of Acceptance of Work and Responsibilities of the Contractor in the Freelance Contracts. The subject has been investigated under five main chapters. The first chapter is on the definition of Freelance Contracts, its legal nature, components and its differences from other similar contracts. The second chapter examines the obligations of the contractor arising from the contract; and the third chapter deals with the obligations of the contractor resulting from the defect. The fourth chapter is on the completion of defect obligation of contractor and the last chapter studies the periods of limination to be applied onto the disputes of Freelance Contracts in accordance with the New Turkish Law of Obligations numbered 6098 to enter into force on July 01, 2012.
