Abstract

Tezin konusu ''Evililik Birliği İçerisinde Diğer Eşin Rızasına Bağlı Hukuki İşlemlerdir.'' Tez giriş ve sonuç bölümleri dışında üç bölümden oluşmaktadır. Birinci bölümde; Türk Hukuk'unda fiil ehliyeti kavramı ve evli kişilerin ehliyet durumu açıklanmıştır. İkinci bölümde; Türk Medeni Kanunu'nda eşin rızasının arandığı haller dört başlığa ayrılmış, tasarruf yetkisinin kısıtlanmasına ilişkin hükmün uygulanmasında, evli erginlerin ve kısıtlıların evlat edinilmesi işleminde, paylı mülkiyet konusu malda pay üzerindeki tasarruf işlemlerinde üstün hak sahibi olan eşin bu hak sahipliğinin niteliğini ve söz konusu haklarını kullanırken hangi hukuki işlemlerin diğer eşin rızasını gerektireceği üzerinde durulmuştur. Mal rejimlerini ilgilendiren düzenlemelerin yanı sıra, aile konutu kavramının kabulü, geçerliliği eşin rızasına bağlanan hukuki işlemlerin kapsamını genişletmiştir. Aile konutunun mülkiyetinin eşlerden birine ait olması ya da kiralanmış olmasına göre eşin rızasına bağlanan hukuki işlemler çalışmada açıklanmıştır. Üçüncü bölümde; kefalet sözleşmesi akdedilmesi durumunda ve aile konutunun kira sözleşmesine konu olması durumunda diğer eşin rızasının alınması hususu incelenmiştir. Tez hazırlanırken konuyla doğrudan ve dolaylı olarak ilgili bulunan tüm eserler taranmaya çalışılmıştır. Bunun dışında, konuyla ilgili mahkeme kararları incelenmiş, konunun uygulamada ne tür uyuşmazlıklara neden olduğu hususuna dikkat çekilmiştir. Kanunun diğer eşin rızasının varlığını aradığı işlemlerde rızanın kapsamı her bir işlem için farklılık arz etmektedir. Bu sebeple her bir işlemde rızanın hukuki niteliği ve sonuçları ayrı ayrı incelenmelidir.

The subject of the thesis is "Legal Procedures Based on Consent of Other Spouse." The thesis consists of three chapters except the introduction and conclusion sections. In the first section; In Turkish Law, the concept of legal capacity and the license status of married persons are explained. Adoption of the concept of family housing, as well as regulations concerning property regimes, have extended the scope of legal proceedings whose validity is subject to the consent of the spouse. The legal procedures that are connected to the consent of the spouse according to whether the ownership of the family residence belongs to one of the spouses or leased are explained in the study. During the preperation of this thesis, all the works directly and indirectly related to the subject were tried to be searched. In addition, the court decisions on the issue were examined and it was tried to show what kind of disputes the issue caused in practice. In cases where the law seeks the existence of the consent of the other spouse, the scope of the consent differs for each transaction. Therefore, the legal nature of the consent and the results of each transaction should be examined separately.
