Kredi kartı sözleşmesi

Abstract

Bu çalışmada, günümüzdeki ekonomik gelişmelere bağlı olarak ülkemizde yaygın bir uygulama alanı bulan ve toplumun neredeyse her kesimini doğrudan ilgilendiren kredi kartı sözleşmeleri incelenmiş; kredi kartı sözleşmelerinin uygulanması sırasında taraflar arasında ortaya çıkan sorunlar üzerinde durulmuştur. Çalışmada, sözleşmenin kanunun öngördüğü Şekil Şartlarına aykırı olarak akdedilmesine bağlanan sonuçlar ile anlaşma unsurunun sağlanmadığı durumlara bağlanan sonuçlar irdelenmiştir. Kredi kartı sistemini oluşturan tarafların sözleşmeden doğan hak ve yükümlülükleri, Banka Kartları ve Kredi Kartları Kanunu, Tüketicinin Korunması Hakkında Kanun ve Borçlar Kanunu kapsamında incelenmiş; ilgili yerlerde kefilin sorumluluğuna değinilmiştir.

This study examines the credit card contracts that have a wide application area in association with current economic developments and that relate almost all sections of the society; with a focus on issues arising between the parties during the application of credit card contracts. The study probes into the outcomes associated with the conclusion of the contract contrary to the formal conditions stipulated under the law and outcomes associated with situations where the element of agreement failed to be addressed. Contractual rights and obligations of the parties constituting the credit card system were studied within the scope of the Law on Bank Cards and Credit Cards, Law on the Protection of Consumers and Law of Obligations; with emphasis on the guarantor‟s responsibilities where applicable.
