(Yeni) bir anayasanın nihai normatiflik kaynağı nedir? hukuki pozitivizmden yanıtlar

Abstract

Bu makalede, Türkiye’deki yeni anayasa tartışmalarının bir boyutu ele alınmaktadır. Bu da, mevcut Meclis’in yeni bir anayasa yapıp yapamayacağı konusudur. Konu güncel ve dolayısıyla tartışmalar pratiğe donuk olmakla birlikte, bu makalede asıl olarak yapılmaya çalışılan, pratik tartışmaları da kapsayacak teorik bir çözümleme girişimi sunmaktır. Bu bakımdan, Kemal Gözler’in konuya ilişkin teorik ve pratiğe yönelik görüşlerini yansıttığı yakın tarihli bir makalesi hareket noktası olarak alınmıştır. Gözler’in asli kurucu iktidar kavram› tahlili üzerinden görüşlerini aktardığı makalesinde, o, mevcut Meclis’in teknik anlamda yeni bir anayasa yapamayacağın› savunmaktadır. Gözler’in izinden gittiği ve pozitivist hukuk felsefesinin güçlü bir temsilcisi olan Hans Kelsen’in Temel Norm kavram› bu kapsamda incelenmiştir. Ancak makalede ortaya konmaya çalışılan fikir, konuya ilişkin bir başka pozitivist hukuk felsefecisi olan Hart’ın görüşlerinin de, meseleye uyarlanabilir olduğu ve Gözler’in savunduğu görüşten farklı bir sonuç doğurabilecektir.In this article, one aspect of the discussions going on around a new constitution in Turkey is dealt with. The said aspect is the issue whether the present Grand National Assembly can enact a new constitution or not. Although the issue is currently under debate, thus the discussions around it have been directed to practical outcomes, the attempt made in this article is to offer mainly a theoretical analysis, which encompasses the practical discussions. In this respect, the starting point is the recently-published article of Professor Kemal Gozler, in which he presented his theoretical and practical views concerning the issue. In the article, in which Gozler presented his views on the issue through the analysis of the concept of constituent power, he claims that the present Grand National Assembly cannot adopt, in the technical meaning, a new constitution. The concept of Grundnorm of Hans Kelsen, being a potent representative of legal positivism, and which Professor Gozler follows, is analyzed in this context. However, the view to be revealed in the article is that the views of H.L.A. Hart, who is another potent representative of the positivistic theory of law, can be adapted to the issue at stake and it can result in a different view from the one advocated by Gozler.
