Destekten yoksun kalma tazminatı

Abstract

Yüksek Lisans tezi olarak hazırladığımız bu çalışmada, destekten yoksun kalma tazminatı incelenmiştir. Destek yoksun kalma tazminatı, uygulamada sıklıkla karşılaşılan bir tazminat türüdür. Destekten yoksun kalma tazminatı, ölüm olayı sonucunda ölen kişinin yaşarken yardımda bulunduğu veya ilerde bulunması muhtemel kişilerin mal varlıklarında oluşan zararların giderilmesinden ibarettir. Bu tazminatı talep edebilmek için öncelikle ölenin, tazminatı talep eden kişiye mevcut veya ileride olması muhtemel desteğinin ispatı gerekmektedir. Bunun yanı sıra destek görenin de ölen desteğin bakımına ihtiyacı olduğu ispatlanmalıdır. Destekten yoksun kalma tazminatı bağımsız karakter ve istisnai nitelik taşıdığı gibi temelini maddi bir zararın oluşturduğu yansıma yoluyla uğranılan bir tazminat türüdür. Destekten yoksun kalma tazminatının kaynağını haksız fiiller, sözleşmeler veya vekalet iş görme oluşturabilir. Destekten yoksun kalma tazminatı hesaplanırken desteğin gelirinin ve elde ettiği ekonomik değerlerin belirlenmesi gerekmektedir. Desteğin ölümüyle, destek görenin elde ettiği menfaatler ile hayatta kalan eşin yeniden evlenme ihtimali destekten yoksun kalma tazminatında indirime sebep olmaktadır. Çalışmamızda destekten yoksun kalma tazminatı ile ilgili doktrindeki tartışmalar ile Yargıtay uygulamalarına yer verilmiştir.In this master's thesis study, compensation for loss of support has been analyzed. Compensation for loss of support is often a type of compensation in practice. Compensation for loss of support is the elimination of damages to property of people who are deceased as a result of the death or who are likely to be helped in the future. In order to claim this compensation, first of all it is necessary to prove that the person who is claiming compensation is present or in the future possible support. In addition to this, it must be proved that the support person needs the care of the deceased person. Compensation for loss of support is not only a type of compensation that has independent character and exceptional qualities, but also it is based on reflection on the basis of material damage. The source of compensation for loss of support may be unfair acts, contracts or act with authority. While the compensation is calculated, the income of the support and the economic values it obtains must be determined. With the death of support, the benefit of the beneficiary and the survivor's spouse lead to a reduction in the compensation for loss of support in favor of the possibility of remarrying. In our study discussions in the doctrine about compensation for loss of support and the Supreme Court applications were included.
