Expert Opinion in the Context of Civil Procedure

Abstract

Gelişen teknoloji ile beraber karmaşık hale gelen sosyal hayattaki uyuşmazlıkların çözümü için hâkimin uzman kişilere başvurması bir gereklilik haline gelmiştir. Hakimlerin, uyuşmazlık hakkında karar verebilmeleri için özel veya teknik bilgiye gerek duymaları halinde mahkemece görevlendirilecek bilirkişilerin yanı sıra tarafların da uyuşmazlık konusundaki iddia ve savunmalarını desteklemek ve davayı aydınlatmak amacıyla uzmana başvurmaları yapılan yasal düzenlemeler ile mümkün hale getirilmiştir. Taraflar dava öncesinde, uyuşmazlık konusu ile ilgili fikir sahibi olmak ya da davadaki başarı şanslarını görebilmek için uzman görüşü alabileceklerdir. Dilekçelerini hazırlayabilmek ya da dava sırasında alınan bilirkişi raporunun eksikliklerini giderebilmek için de uzman görüşü alınabilecektir. Böylelikle mahkemenin gerçeğe ulaşmasına taraflarca katkı sağlanabilecektir. İlgili çalışmada uzman görüşü kurumu diğer kurumlarla karşılaştırılarak incelenecektir. Uzman görüşü kurumuna gereken değerin verilmesi halinde yargılamaya sağlayacağı katkılardan bahsedilerek kurumun önemine dikkat çekilecektir. It has become a necessity the judge to apply to experts for the resolution of disputes in social life, which has become complex with the developing technology. In the event that the judges require special or technical knowledge in order to decide on the dispute, the legal regulations have made it possible for the parties to apply to experts in order to support their claims and defenses on the dispute and to enlighten the case, as well as the experts to be appointed by the court. The parties may seek expert opinion before the lawsuit in order to have an idea about the subject matter of the dispute or to see their chances of success in the lawsuit. Expert opinion can also be obtained in order to prepare their petitions or to correct the deficiencies of the expert report received during the case. Thus, the parties will be able to contribute to the court's reaching the truth. In the relevant study, the institution of expert opinion will be examined by comparing it with other institutions. If the expert opinion institution is given the necessary value, the importance of the institution will be emphasized by mentioning the contributions it will provide to the proceedings.
