Uluslararası belgeler ve Türk Hukukunda eğitim hakkı

Abstract

Bu çalışmada eğitim hakkı, Türk Hukuku ve Uluslararası düzenlemeler çerçevesinde incelenmiştir. Eğitim ve eğitim hakkı kavramlarının ne anlama geldiği ifade edilmiş, daha sonra uluslararası düzenlemelerde ve özellikle Avrupa İnsan Hakları Sözleşmesi ile Avrupa İnsan Hakları Sözleşmesi'ne Ek 1. Protokol'ün 2. Maddesi kapsamına eğitim hakkının ne şekilde düzenlendiği ve sınırları incelenmiştir. Sonrasında, Türkiye Cumhuriyeti Anayasaları'nda eğitim hakkının tarihsel süreç içerisinde geçirdiği değişiklikler anlatılmaya çalışılmıştır. Çalışma içerisinde sonuç olarak ise, Türkiye'deki eğitim hakkına ilişkin belirlenen sorunlar, uluslararası düzenlemeler çerçevesinde değerlendirilmiş ve bu sorunlara ilişkin çeşitli çözüm önerileri maddeler halinde sıralanmıştır. Tüm bu incelemeler çerçevesinde, eğitime hakkına ilişkin olarak başta Anayasamız olmak üzere ciddi yasa değişikliklerin yapılması ve eğitim hakkı düzenlenirken, ideolojik yaklaşımlardan uzak durulması gerektiği anlaşılmıştır.

In this study, the right to education , in the framework of the Turkish Law and International regulations have been investigated..
