Abstract
Uluslararası Ceza Hukuku, insanlık suçları, savaş suçları ve soykırımlar gibi büyük suçları cezalandırmayı amaçlayan bir hukuk dalıdır. Nürnberg Yargılamaları, uluslararası ceza hukukunun temellerini atarak, bireylerin hem devlet adına hem de kişisel olarak suçlu olabileceğini ortaya koymuştur. Tokyo Mahkemesi ise Asya'daki savaş suçlarını cezalandırmış ve bölgesel adaletin sağlanmasında önemli bir rol oynamıştır. Eski Yugoslavya ve Ruanda'daki savaş suçları için kurulan mahkemeler (EYUCM ve URCM), uluslararası ceza hukukunun uygulanabilirliğini göstermiş ve insanlık suçlarına karşı adaletin sağlanmasında katkıda bulunmuştur. Uluslararası Ceza Mahkemesi (UCM), daimî bir mahkeme olarak, tüm dünyada savaş suçları, soykırımlar ve insanlığa karşı suçlar gibi suçlarla mücadele etmektedir. Ancak UCM, devletlerin iş birliği eksiklikleri ve bazı suçluların yargılanamaması gibi zorluklarla karşı karşıyadır. Sonuç olarak, uluslararası ceza mahkemeleri, dünya çapında adaletin sağlanmasında kritik bir rol oynamakta, ancak daha etkili olabilmesi için devletlerarası iş birliği ve uluslararası hukuk normlarının güçlendirilmesi gerekmektedir. Uluslararası ceza hukukunun gücünün arttırılması, insanlık suçlarına karşı mücadelede devamlılık sağlayacaktır.
International criminal law is a branch of law that aims to punish major crimes such as crimes against humanity, war crimes, and genocides. The Nuremberg Trials laid the foundations of international criminal law, establishing that individuals can be held personally responsible for crimes, not just in the name of the state. The Tokyo Trials, on the other hand, punished war crimes in Asia and played an important role in regional justice. The tribunals established for war crimes in the former Yugoslavia and Rwanda (ICTY and ICTR) demonstrated the applicability of international criminal law and contributed to the establishment of justice for crimes against humanity. The International Criminal Court (ICC), as a permanent court, combats crimes such as war crimes, genocides, and crimes against humanity worldwide. However, the ICC faces challenges, including the lack of cooperation from states and the inability to prosecute some criminals. In conclusion, international criminal tribunals play a critical role in ensuring justice worldwide. However, for them to be more effective, enhanced inter-state cooperation and the strengthening of international legal norms are necessary. Increasing the power of international criminal law will ensure the continuity of the fight against crimes against humanity.
