Abstract
Demokratik hukuk devleti idealinde anayasaların, siyasi iktidarları sınırladıkları, temel hak ve hürriyetleri güvence altına aldıkları yaygın bir şekilde kabul edilir. Bireylerin hak ve hürriyetlerinin anayasal hükümlerle koruma altına alındığı bir hukuk devletinde hükmetme kudretini sadece anayasal sınırlar içerisinde kullanabilen siyasi iktidarların otoriter bir keyfilik içerisinde olamayacağı kuşkusuzdur. Siyasi iktidarların kudretlerini sınırlandıran anayasalar, kötü niyetli iktidar sahipleri için bir prangadır. Bu pranga, yıllarca askeri darbeler gibi geleneksel metotlarla kırılmaya çalışılmıştır. Ancak son yıllarda bu geleneksel metotlardan rücu eden anti demokratik irade, artık tespiti eskisi kadar kolay olmayan stratejiler keşfetmiştir. Siyasi iktidarlar, anayasaları ortadan kaldırmak yerine otoriter veya yarı-otoriter rejimler oluşturmak maksadıyla anayasal araçları bir enstrüman olarak kullanmaya başlamışlardır. Bu çalışmada, anti demokratik iradenin bu yeni stratejisi, anayasaların istismar edilmesi başlığıyla tahlil edilmeye çalışılmıştır.
In the democratic rule of law, it is widely accepted that constitutions limit political powers and guarantee fundamental rights and freedoms. In a state of law where the rights and freedoms of individuals are protected by constitutional provisions, it is beyond doubt that political powers, which can exercise their power to rule only within constitutional limits, cannot be in an authoritarian arbitrariness. Constitutions, which limit the power of political powers, are a shackle for malicious power holders. For years, this shackle has been tried to be broken by traditional methods such as military coups. However, in recent years, the anti-democratic will, which has recanted from these traditional methods, has discovered strategies that are no longer as easy to detect as before. Instead of abolishing constitutions, political powers have started to use constitutional instruments as an instrument in order to create authoritarian or semi-authoritarian regimes. In this study, this new strategy of the anti-democratic will is analysed under the title of the abuse of constitutions.
