Bilirkişi etiği

Abstract

Bilirkişi etiğinin medenî usul hukukunda uygulamasının anlatılacağı bu çalışmada yargılama faaliyetinde önemli yere sahip bilirkişilerin uyması gereken bu ilkelerin uygulamada yaşanan sorunların çözümündeki etkin rolü ele alınacaktır. Çalışma, iki bölümden oluşmaktadır: Birinci bölümde, bilirkişinin yargısal faaliyetteki yeri ve öneminden bahsedilecek; ardından bilirkişinin tanımı ve hukukî niteliğinden söz edilip bilirkişilik faaliyetinin yargılama hukukuna egemen olan bazı hak ve ilkeler ile ilişkisi ele alınacak ve bilirkişiliğe özgü temel ve etik ilkelerin bu ilkeler arasındaki yerine değinilecektir. Bu başlık altında bilirkişiliğe egemen ilkeler çerçevesinde bilirkişilerin kendi ödevleri ile hâkimin veya tarafların ödevlerini ayırt etme zorunluluğu olduğuna vurgu yapılacaktır. Ardından etik ilkeler başlığı açılıp etik ilkelerin anlamı ve önemi üzerinde durulacak, benzer kavramlarla etiğin karşılaştırması yapılacak ve asıl konumuz olan bilirkişi etiğinin görünüş biçimlerinden kısaca bahsedilecektir. Çalışmanın ikinci bölümünde ise bilirkişi etiğinden genel olarak söz edilecek, bu etik ilkelere uygun hareket etme gerekliliğinden bahsedilecek ve bilirkişilerin etik ilkelerin ihlali halinde karşılaşacağı yaptırımlar hakkında önceden uyarılması gerekip gerekmediği tartışılacaktır. Ardından bilirkişi etiği ile bilirkişilerin kendi meslek etik ilkelerinin çatışması durumunda bilirkişilerin nasıl davranması gerektiği sorunu üzerinde durulacaktır. Sonrasında bilirkişi etiği bakımından yeminin önemine değinilip asıl çalışma konumuzu oluşturan etik ilkeler tek tek ele alınacaktır.The role of the principles that should be followed by experts, who have an important place in judicial activity, and the ability of these principles to solve problems experienced in practice will be discussed in this study in which the application of expert ethics in civil procedural law will be described. The study consists of two parts: In the first part, the place and importance of the expert in judicial activity will be mentioned; after that, the definition and legal nature of the expert will be discussed; the relationship of the expert's activity with some rights and principles that are dominant in judicial law will be discussed and the place of the basic and ethical principles specific to the expert witness will be mentioned. Under this heading, an emphasis will be put on the fact that the experts have to distinguish between their own duties and the duties of the judge or the parties within the framework of the principles prevailing in being an expert. Then, the title of ethical principles will be introduced under which the meaning and importance of ethical principles will be emphasized, the comparison of ethics with similar concepts will be made, and our main subject, the appearance forms of expert ethics will be briefly mentioned. In the second part of the study, the ethics of the expert in general and the necessity to act in accordance with these ethical principles will be mentioned; whether the experts should be warned in advance regarding the sanctions that they will face in case of a violation of an ethical principle will be discussed. Then, the question of how experts should act in case of a conflict between expert ethics and experts' own professional ethical principles will be reviewed. Afterwards, the importance of the oath in terms of expert ethics will be mentioned and the ethical principles that constitute our main study will be discussed one by one.
