Searching, Copying, Seizure and Evaluation of Digital Evidence in Computers, Computer Programs and Files within the Scope of CMK m.134

Abstract

Teknoloji, günümüzde hızla değişmek suretiyle toplumun tüm kurumlarını etkilediği gibi hukuku da doğrudan etkilemektedir. Nitekim birçok suç, teknolojik aletlerin sağladığı kolaylıklar aracılığıyla işlenmekte veya doğrudan teknolojik aletler suçun konusunu oluşturmaktadır. Bu durumda yaşanan hızlı değişim, dijital delillerin elde edilmesi, toplanması ve muhafaza edilmesi konularında adli yönüyle uyum zaruretini doğurmaktadır. Zira çalışmamızın konusunu oluşturan bilgisayarlarda, bilgisayar programlarında ve kütüklerinde arama, kopyalama, elkoyma koruma tedbiri de bu uyumun somut yansıması olarak karşılığını bulmaktadır. Bu çalışma iki bölüm olarak hazırlanmıştır. Çalışmanın konusunu oluşturan bilgisayarlarda, bilgisayar programlarında ve bilgisayar kütüklerinde arama, kopyalama ve elkoyma tedbiri mahiyeti itibarıyla koruma tedbiri olup arama koruma tedbirinin özel bir görünümünü oluşturmaktadır. Bu nedenle çalışmanın birinci bölümün ilk kısmında koruma tedbiri kavramı ve özellikleri izah edilmiştir. Birinci bölümün ikinci kısmında ise mahiyeti itibarıyla fiziksel delillerden ayrılan dijital delil kavramı, analog delil ile ayrımı ve ispat gücü detaylıca irdelenerek Ceza Muhakemesi Kanunu'nda doğrudan yer alan ve almayan bilişim sistemi cihazları izah edilmiştir. Çalışmanın ikinci bölümünde ise CMK m.134'te kaleme alınan bilgisayarlarda, bilgisayar programlarında ve kütüklerinde arama, kopyalama, elkoyma tedbiri amacı, konusu, hukuki niteliği, benzer niteliği haiz diğer tedbirlerle ilişkisi, uygulanması, tedbir sonrası elde edilen verilerin imhası tesadüfen elde edilen delillerin akıbeti, tedbire karşı kanun yolları, uygulanmasındaki sorunlar ve çözüm önerileri hususları dijital deliller kavramı ile ilişkilendirilerek değerlendirilmiştir. Çalışma hazırlanırken 5271 Sayılı Ceza Muhakemesi Kanunu, öğreti ve yargı kararlarından yararlanılmıştır.Technology, which rapidly evolves in the modern era, directly affects all institutions of society, including the law. Many offences are committed through the conveniences provided by technological devices, while in some cases these devices themselves constitute the very subject of the crime. This swift transformation necessitates procedural adaptation in terms of the forensic acquisition, collection, and preservation of digital evidence. The protective measure of searching, copying, and seizing computers, computer programs, and log files examined within the scope of this study represents a concrete reflection of such adaptation. This thesis is structured in two main chapters. The first chapter initially explains the concept and characteristics of protective measures. In the second part of the first chapter, the concept of digital evidence, its distinction from analog evidence, and its evidentiary value are examined in detail, along with an analysis of information system devices expressly regulated or not expressly regulated under the Code of Criminal Procedure. The second chapter evaluates the protective measure laid down in Article 134 of the Criminal Procedure Code searching, copying, and seizing computers, computer programs, and log files by examining its purpose, subject matter, legal nature, its relationship with other similar measures, its procedural application, the destruction of data obtained after the measure, the fate of incidentally obtained evidence, available legal remedies against the measure, and the practical challenges encountered, together with proposed solutions. While preparing this study, the Code of Criminal Procedure No. 5271, doctrinal opinions, and judicial decisions were utilized.
