Toplu iş sözleşmelerinde işçi sendikalarının yetkisi

Abstract

Bu çalışma Türk iş hukukunda işçi sendikalarının yetkisini mevzuat üzerinden inceleyen bir çalışmadır. Sendikal örgütlenme modelleri ve bunun yansıması olan yetki sürecinin yasal boyutu, tüm güncellemeleri ile ele alınmış ve kapsamlı bir literatür taraması yapılmış, Yargıtay kararları ile desteklenmiştir. Bu çalışmada mevzuat değişiklikleri kronolojik sıra ile takip edilmiş ve torba yasalar ile hukuk sistemine dâhil edilen tüm süreçler izlenmiş, işkolları farklı sendikaların işyeri ve işletmelerle imzaladığı bazı toplu iş sözleşmesi örnekleri incelenerek son hali verilmiştir. The legal dimension of trade union organization models and its reflection, which is the reflection of the authorization process, has been handled with all updates and a comprehensive literature review has been made and supported by the Supreme Court decisions. In this study, the legislative changes were followed in chronological order and all the processes included in the bag laws and legal system were followed and some collective contracts signed with the different trade unions and businesses were examined and finalized.
