Resmi belgede sahtecilik suçu

Abstract

Ticari ve hukukî hayatın akışı içerisinde resmi belgeler sıkça kullanılan yazılardır. Resmi belgeleri, kamu görevlilerin düzenlemesi nedeniyle toplumda bu belgelerin gerçekliğine duyulan güven oldukça fazladır. Resmi belgede sahtecilik suçuyla toplumda bu tür belgelerin geçerliliğine ve gerçekliğine duyulan inanç korunmak istendiğinden resmi belgede sahtecilik suçu 5237 sayılı Türk Ceza Kanunu'nun sistematiğinde ''Topluma Karşı Suçlar'' başlıklı üçüncü kısmın ''Kamu Güvenine Karşı Suçlar'' isimli dördüncü bölümünde düzenlenmiştir. Bu kapsamda suçun hukukî konusu kamu güvenidir. Gelişen teknolojik düzenle beraber ortaya çıkan bilişim sistemleri toplumsal hayatta önemli bir yer tutsa da resmi belgelerin hukukî ve sosyal önemi geçmişten günümüze var olmaya devam etmiştir. Bu çalışmanın amacı; yüksek mahkeme kararlarından, doktrinden, güncel gelişmelerden, konuyla ilgili benzer çalışmalardan, 765 sayılı mülga Türk Ceza Kanunu'ndaki düzenlemelerden yararlanarak, yürürlükteki 5237 sayılı TCK'da düzenlenen resmi belgede sahtecilik suçunu bütün detaylarıyla inceleyip doğru, sağlam bilgi vermek ve uygulamada tartışma içeren ve önem arz eden konularda hukukî görüşümüzü ortaya koymaktırOfficial documents are writings frequently used in commercial and legal flow of life. As they are drawn by public servants, the public bears a great trust regarding authenticity of official documents. The offence of falsification of official documents is intended to protect this public trust in validity and authenticity of such documents and therefore the offence of falsification of official document is provided in the system of the Turkish Criminal Code numbered 5237, Section Three titled "Crimes against the Public", under Part Four titled "Crimes against Public Trust". In this scope, the legal subject of this offence is the public trust. While information systems arising with the advancing technologic systems came to hold an important place in public life, legal and social importance of official documents continues to hold true from past to modern day. The purpose of this work is to examine the offence of falsification of official documents, as provided under the Turkish Criminal Code numbered 5237 in force, in detail referring to high court decision, doctrine, current developments, similar works related to the subject and the provisions of the annulled Turkish Criminal Code numbered 765 in order to provide correct and valid information and to present our legal opinion regarding important points that are subject to discussion in practice.
