Adli yargıda makul süre felsefesi ve matematiği

Abstract

: Genelde, yönetim sisteminde performansın bir kısmı olarak adli mahkemelerin faaliyetleri değerlendirme konusu olmaktadır. Bu çalışmamızda yargılama ve sonrası geçen süre itibariyle bir değerlendirmeye tanık olunacaktır. Bu konu özünde adli işlerin organizasyonu için optimum sürenin saptanması sorusunu gündeme getirmektedir. Bu saptama kuşkusuz, adalete güven duygusunun yerleşmesi için atılacak ilk adımdır. Bu çalışmada yapılan ceza/hukuk davalarının her evresine özgü ortalama süreler(gün) olarak sergilenmiştir. Geneldeki görüntü ötesinde bireysel davalara bakıldığında beş yıl ve fazla süren davaların sayısal değeri küçümsenmeyecek orandadır. Bu süre aşımını etkileyen ve yapay iş yaratan değişkenler arasında adli kırtasiyecilik yer almaktadır. Adalet kırtasiyeciliği, kuşkusuz, adaletin kendisi değildir.In general, the activities of the judicial courts have been evaluated as part of the performance management process. Here, we took the evaluation in terms of measurement of time passed by during the trail and thereafter. This brings about the question of determination of the optimum processing times for the organisation of judicial works. This is the starting point for public confidence in justice. What is measured here is the avarage time(days) for each step both in criminal and civil justices. When we look at the individual cases, it is not unusual to see a civil/crimal case lasting more than five years. One significant factor of the delays in case processing is the judicial red-tape; though, judicial red-tape is not the justice by itself.
